Employee Credit Checks Banned Effective January 1, 2011

Employers will be prohibited from doing credit checks on prospective employees under a new Illinois law. The new law that was just signed by Governor Quinn will be effective January 1, 2011. There are a few exceptions for employers in the banking and insurance industry and those dealing with trade secrets.

  1. It amazes me how the government wants to step in and prevent businesses from hiring top notch employees. I understand where they feel credit checks are not helpful in a credit poor economy, such as this one, but they should not stop employers from using it as a tool. The IL government would be smarter if they actually went against credit scoring companies who regularly mess up 80% of all individuals credit reports.
